Buyers Broker -- What does that mean for you... ?

Florida "legal" definitions:

  • The State of Florida in 1998 eliminated "Dual Agency", which means a listing agent can not also represent the buyer in a real estate transaction.
  • The Selling Broker would have to have both the seller & the buyer sign a document allowing the Selling Broker to represent both parties, but neither in a fiduciary relationship.
  • The "Buyers Broker" has the legal & moral duties to the buyer such as "Deal honestly & fairly", "Confidentiality", "Obedience", and "Full disclosure"
  • The "Buyers Broker" also has an additional fiduciary relationship with the buyer.
    The "Selling Broker" can not, since theirs is to the seller.

  • We have a fiduciary relationship with our clients.
  • We have no listings therefore, we can provide the following services:
    • Show you properties that meet your criteria, not the selling brokers.
    • We can discuss the quality of construction using Mr. Walton's seventeen years experience in constructing multi-million dollar homes in many of the finest communities of Naples.
    • With one relationship (24K Realty), you will be exposed to all the property that meets your criteria. You'd have to see many Selling Brokers and Country Club communities to obtain what we provide in one stop.
    • We will, if requested, meet you at the airport, help with your hotel reservations at such fine hotels as The Ritz and Registry, and in short "show you this fine little town of Naples".
    • We have our attorneys draw up the paper work for closing, and they are on staff to answer any questions you may have about real estate, State of Florida residency, taxes, Florida estate planning, and the like.

What does all this extra service cost?

NOTHING

  • We are paid via the "Co Brokers" agreements with the different "Selling Broker",
    at the time of closing.
  • In the new Country Club communities, we are also paid from the normal sales commissions paid for new sales. We just ask, we be registered as the "Buyers Broker" when we introduce you to the Sales Staff and/or the Builders.

Things to remember:

  • "Selling Agents" are working for their listed sellers. What do they show?
  • "Country Club Community" sells their community, to them there is "no other" therefore you would never get referred to the great one "down the street"!
  • We have a fiduciary and legal duty to represent you, the buyer.
